Were You Injured in an Uber or Lyft Ride?

Navigating the Complexities of Ride-Sharing Insurance

Uber and Lyft accidents present unique challenges because they involve multiple insurance policies: the driver’s personal policy, the rideshare platform’s policy, and, in some cases, the at-fault driver’s insurance. Determining which policy applies depends on the status of the app at the time of the accident.

The attorneys at Windsor Troy Law have the expertise needed to navigate the complexities of rideshare claims. We know how to hold Uber and Lyft accountable for their insurance obligations and how to maximize compensation for our clients in California and Texas.

Frequently Asked Questions

Clear Answers About Your Case

These are the most common questions we receive. If you need immediate help, call us now.

How much insurance do Uber and Lyft have?+

Uber and Lyft maintain $1 million in coverage when a driver is carrying a passenger or on the way to pick one up. When the app is active but no ride has been accepted, coverage is lower ($50,000–$100,000 per person). If the app is turned off, only the driver’s personal insurance applies.

What should I do after an Uber or Lyft accident?+

Call 911 and seek medical attention immediately. Take screenshots of the app showing the active trip, take photos of the accident, and collect information from all drivers. Contact a lawyer before contacting Uber, Lyft, or their insurance companies.

Can I sue Uber or Lyft directly?+

Uber and Lyft classify their drivers as independent contractors, which generally limits their direct liability. However, you can file a claim through their commercial insurance policy. In certain cases, such as negligence in hiring the driver, the company may be directly liable.

How long do I have to file my claim?+

In California and Texas, the statute of limitations is generally two years. It is important to act as soon as possible to preserve digital evidence, such as travel records and GPS data, which may disappear over time. Our attorneys can begin the investigation immediately.

What happens if Uber or Lyft deny my claim?+

It’s common for rideshare insurance companies to initially deny or downplay claims. Our attorneys are familiar with their tactics and have the experience needed to push for and secure the compensation you deserve. Don’t accept the first offer without consulting us—it’s usually much lower than what you’re entitled to.

What compensation am I entitled to?+

You may be entitled to compensation for medical expenses, rehabilitation, lost income, pain and suffering, and permanent disability. In serious cases, such as those involving severely injured passengers or pedestrians, compensation may reach the $1 million limit of the Uber or Lyft policy.
